The team of professionals from SitesGy appreciates that our potential and/or user are willing to read our Terms of Service. Therefore, these Terms of Service must be read considerately before using the website, http:/, & http://www.siteswebbuilder.com operated by Sites.gy Website Builder.
However, your access to and use of the service is conditioned on your acceptance of and compliance with these Terms. In addition, we have absorbed the principle of business efficacy which is normally invoked to read a term in an agreement or contract so as to achieve the result or the consequence intended by the parties acting as prudent businessmen. Business efficacy means the power to produce intended results.
Therefore, these Terms apply to all who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.

Our services are designed to allow people from all over the world to easily create enticing and professional online presence for themselves as well as customers, to manage and promote their business through E-commerce and blogging and most importantly to have a great experience in designing their personal website.
We provide our users with a number of tools and features for creating and publishing extraordinary websites. These websites can take a gamut of choices such as arts and designs, business services, blogging, e-commerce and retail fashion, webpage building, mobile applications, galleries, media, newsletters and online stores and other applications – by using content and features offered by Sites and others via our services (collectively – “User Website(s)”). Some features of websites include: business services, arts and design, health and wellness, photography, restaurant and food, retail fashion (e-commerce), weddings, music and videos, lodging and technology.
A. 2. LEGAL AGREEMENT
Signing up for Sites.gy service creates a contract between you and us. This will consist of the order of use, the applicable service description and this user/client agreement. Therefore, you are agreeing to be bound by the terms of this agreement and all terms and conditions incorporated by reference in this agreement, including our acceptable use policy. Your use of the services constitutes acceptance of this agreement.
These Terms of Services or Agreement laid down will govern the different services proffered by Sites.gy (“we”, “us” or “our”) including the link www.sitesbuilders.net / www.siteswebbuilder.com . In addition to this, any tools, options or portholes may be operated from time to time by us.
Furthermore, the terms below are considered to be legally binding on our part as well as yours for the use of the services performed by SitesGy. Therefore, these Terms apply to a “Webpage Builder” (which means that you have used SitesGy to create a website), a “Partner/Member” (which means that you have created an account with SitesGy) and the term “User/Client” refers to a Visitor or a Member or a Webpage Builder.
In addition, by creating a website or using any service offered by SitesGy you are agreeing to be bound by the terms laid down by the Terms of Service and these Terms of Service as well as others posted from time to time will govern your use of services.
Therefore, the team of professionals from SitesGy advises all visitors, users and those who use or access the service to carefully and considerately read these Terms of Service before using the website and/or services, as they affect your rights and liabilities. If you choose to disagree with any part of the Terms then you may not access the service.
A. 3. SITES.GY USER/CLIENT AGREEMENT
Firstly, in order to embark upon performance of using or accessing services by Sites.Gy, you must register for an account by providing relevant information (“User/Client Agreement”).
To become a Website Holder with your own web site, you must provide SitesGy with a valid email address, nickname, telephone contact ("Sign up Data"). As a Website Holder, you will select a suitable password for your websites during the Service's sign up process. You, the website holder, is responsible for all maintenance and confidentiality of your account information.
In addition, you are fully responsible for the gamut of activities under your account and password. You agree to: (1) instantly notify Sites.Gy in writing of any unauthorized/unapproved use of your password or account or any other breach of security, and (2) ensure that you exit from your account at the end of each session/period. SitesGy cannot and will not be liable for any loss or damage arising from your negligence/failure to comply with this Section A. 3.
In consideration of use of the Service, you agree to: (1) provide honest, precise, up to date and complete information about yourself (the website holder) as prompted by the Service's registration form, and (2) maintain and promptly update the Registration Data to keep it honest, precise, up to date and complete. If you provide any information that is dishonest in nature, ambiguous, out of date or incomplete, SitesGy has reasonable grounds to suspect that such information is dishonest, ambiguous, out of date or incomplete, SitesGy has the right to suspend or terminate your account and refuse any and all current or future use of the Services proffered by SitesGy.
B. ACCOUNT ELIGIBILTY/CAPACITY
You must be 18 years or older or at least the age of majority in the jurisdiction where you reside or from which you use this Service.
In addition, Sites.Gy reserves the right to reject any applicant that is under suspicion of illegal/unethical or any dishonest/inappropriate activity.
C. SITES.GY ACCEPTABLE USE POLICY
Sites.Gy as mentioned before is a modern, responsive and easy to use website builder. However, an “Acceptable Use Policy” describes the gamut of materials that are prohibited using SitesGy services. These materials may include photos, images, videos, graphics, written content, audio files, code, information, data or other content uploaded, collected, generated, stored, displayed, distributed, transmitted or exhibited on or in connection with the “Website Holder”.
Below is a gamut of activities that are completely prohibited on any website using SitesGy services:
1. Child Exploitation: You may not offer goods or services, or post or upload “Materials” that exploit or abuse children, including but not limited to images or depictions of child abuse or sexual abuse, or that present children in a sexual manner.
2. Pornography: You may offer any services relating to pornography as your subscription will be terminated effectively immediately and a report will be made to the authorities of such unethical business.
3. Harassment, Bullying, Defamation and Threats: You may not offer goods or services, or post or upload “Materials” which harass, bully, defame or threaten a specific individual.
4. Hateful Content: You may not offer goods or services, or post or upload “Materials”, which condone or promote violence against people based on race, ethnicity, color, national origin, religion, age, gender, sexual orientation, disability, medical condition or veteran status.
5. Illegal Activities: You may not offer goods or services, or post or upload “Materials”, that contravene or that facilitate or promote activities that contravene, the laws of the jurisdictions in which you operate or do business.
6. Intellectual Property: You may not offer goods or services, or post or upload “Materials”, which infringe on the copyright or trademarks of others.
7. Malicious and Deceptive Practices: You may not use the Services to transmit malware or host phishing pages. You may not perform activities or upload or distribute “Materials” that harm or disrupt the operation of the Services or other infrastructure of SitesGy or others, including SitesGy’s third party providers. You may not use the Services for deceptive commercial practices or any other illegal or deceptive activities.
8. Personal and Confidential Information: You may not post or upload any “Materials” that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers, confidential national ID numbers, or account passwords unless you have consent from the person to whom the information belongs or who is otherwise authorized to provide such consent.
9. Self-Harm: You may not offer goods or services, or post or upload “Materials”, which promote self-harm.
10. Spam: You may not use the Services to transmit unsolicited commercial electronic messages.
11. Terrorist Organizations: You may not offer goods or services, or post or upload “Materials”, which imply or promote support or funding of, or membership in, a terrorist organization.
The team of professionals at SitesGy has the right to an absolute decision as to whether or not a particular Website Holder is in violation of the “Acceptable Use Policy”. Therefore, at any point in time, an account will be suspended or terminated due to unethical or illegal business done using SitesGy services.
Furthermore, SitesGy has the right, but no obligation, to monitor and investigate each website or each service proffered. Therefore, our final decision as to whether the Website Holder is in violation with SitesGy Terms of Services will be final, legally binding on both parties.
Moreover, SitesGy can at any point in time modify its Terms of Service so SitesGy professionals advise each Website Holder to continuously keep updated. By continue to use services offered by SitesGy, it gives the indication that you, the website holder, has complied with all the latest terms and conditions. In the event of any conflict between the “Acceptable Use Policy” and the Terms, this AUP will take precedence, but only to an extent required to resolve the conflict. Capitalized terms used but not defined in the “Acceptable Use Policy” shall have the meanings set forth in the Terms.
Additionally, if you feel that any Website Holder is in violation of the “Acceptable Use Policy”, then a report can be made to support@sitesbuilders.net.
D. SITES.GY PRIVACY POLICY
We respect your privacy and want to make your experience visiting our website located at www.sitesbuilders.net or www.siteswebbuilder.com and using our services as enjoyable and rewarding as possible. This Privacy Policy describes what personal information of our Website Holders ("Website Holders") and visitors ("Visitors") (collectively, "Users") is collected and how and when it might be used or shared by Sites.Gy.
WHO WE ARE. SitesGy provides modern, responsive and easy to use website builders, including web-hosting, domain name and related products and services, to businesses, individuals, non-profit organizations and others.
1. INFORMATION WE COLLECT. We collect information in different ways from Users who may access our services, or the network of websites accessible through our services.
a. Registration and Account Information. Website Holders are asked to provide certain personal information when they sign up for our services including an email address, phone number, nickname and a password and billing information (such as a credit card number), but this will only be needed if the premium plan is chosen. Website Holders may also be asked to complete an online survey once in a while that collects information about demographics, product usage and preferences, along with other information that will help us improve our products and services.
b. Social Media. Our website includes social media features (such as the Facebook "Like" button). These features may collect your IP address and which page you are visiting on our website, and may set a cookie to enable the feature to function properly. Social media features and widgets may be hosted by a third party or directly on our website. Your interactions with these features are governed by the privacy policy of the company providing the feature.

When you visit or make purchases through these third party sites, you may be asked to provide personal information, such as your name, address, email address, phone number, and credit/debit card information. Please note that in such cases, you are providing information to a third party and we have no control over such third party's use of any information you provide and, therefore, we have no responsibility or liability for the manner in which the third party that operates a linked website may collect, use, disclose, secure or otherwise treat your personal information. Except as provided herein, we will not provide any of your personal information to any third parties without your consent.
2. USE OF INFORMATION. We use the information we collect to provide cloud-based product solutions and services along with collecting payment. Passively collected information, such as information collected from or about your device including through the placement or reading of cookies or other tracking technologies is used to provide a customized experience as you use our services.
. User Contact/Account Information. The information collected from Website Holders is used to manage each Website Holder’s account (such as for billing and account management purposes) and to promote other products or services that we believe may be of interest to the Subscriber. We may also generate aggregate profiles from information that Website Holder’s provide during registration (such as the total number of Subscribers in a given category). As explained in more detail below, we may in certain instances use aggregated and non-identifying information to promote advertisements that appear on our website and in connection with our services.
a. Analytics/Statistics. We use information gathered from our website analytics (for example, User IP addresses) to help diagnose problems with our servers, and to administer and optimize our website. We also gather broad demographic information from this data to help us improve our website and make your browsing and purchasing experience more responsive, efficient, or enjoyable. Any statistics gathered by us are proprietary property of the Company.
b. Responses to Email Inquiries. When Website Holders send email inquiries to us, the return email address (and other personal information provided in the inquiry) is used to answer the email inquiry we receive.
c. Customer Surveys. We may use the contact and other information provided to follow up with Website Holders who respond to our customer surveys to help resolve issues internally or with our third party partners. For example, we may contact Website Holders based on their survey answers or to highlight certain changes we made in response to User feedback.
3. SHARING OF PERSONAL INFORMATION OR NON-IDENTIFYING AGGREGATED DATA. From time to time, we may share personal information when we believe that such disclosure is required by law, to deliver a product or service.
. Product and Service Partners. Some products or services are offered or promoted to Website Holders in conjunction with a partner or sponsor. For example, we may partner with other corporate affiliates of the Company or with trusted non-affiliated partners for co-promotions of a particular product or service. We may share certain User information such as contact or demographic information, but no billing information, with such partners or sponsors in order to provide the relevant services or to run the promotion. If we share User information with such partners and sponsors, we require that they maintain the User information in confidence, and use the information solely for purposes of providing the services or carrying out the agreed upon promotion.
a. Service Providers. We may transfer (or otherwise make available) your personal information to third parties that help us provide our services or provide services on our behalf. For example, we may use service providers to authorize and process payments, administer surveys, or run promotions. Your personal information may be maintained and processed by our third party service providers in the United States (mostly for billing transactions), Guyana or in other jurisdictions. Our service providers are given the information they need to perform their designated functions, and we do not authorize them to use or disclose personal information for their own marketing or other purposes.
b. Online Advertisements. We do not share personally identifiable information about individual Website Holders with advertisers. We may display online advertisements and we may share aggregated and non-identifying information about our Users that we collect through the registration process or through online surveys and promotions with certain advertisers. In some instances, we use this aggregated and non-identifying information to deliver tailored advertisements. For example, an advertiser may tell us the audience they want to reach (e.g., males between 25 and 55 years of age) and provide us with an advertisement tailored to the audience. Based upon the aggregated and non-identifying information we have collected, we may then display the advertisement to the intended audience.
c. Customer Surveys. We may share Website Holder information obtained from customer surveys within the Company and with trusted third parties to develop or provide products and services that we believe would be of interest to the User.
d. Sale of Business. f. Domain Registration. In Guyana’s jurisdictions, the University of Guyana reserves all rights to creations of Domains (“Domain Name Registration Information”). The database lists the Domain Name Registration Information for a particular domain name, the name server(s) to which the domain name points, and the domain name's creation and expiration date. The Domain Name Registration Information you provide is hosted by us or a third party service provider and is made available to the public through searches (SEO). We may also deposit your Domain Name Registration Information with a third-party escrow provider.
4. YOUR OPTIONS
. Public Forums. Please remember that any information you may disclose or post in our User directory, spotlights/case studies, testimonials, forums, or other public areas of our websites or the Internet, becomes public information. You should exercise caution when deciding to disclose personal information in these public areas. To request removal of your personal information from our community forums or testimonials, contact us at support@sitesbuilders.net . In some cases, we may not be able to remove your personal information, in which case we will let you know why we are unable to do so.
a. Unsubscribe/Opt-out. When you become a Website Holder of support@sitesbuilders.net, you are automatically registered to receive transactional notices about your account, email newsletters and news of special promotions proffered through SitesGy.
To repudiate from SitesGy newsletters and promotional mailings, email us at support@sitesbuilders.net . If you would like to cancel your SitesGy premium plan, please contact SitesGy support through our online support link.
How to Access or Modify Your Information. We allow you to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. You may request access, updating and corrections of inaccuracies in your personal information we have in our custody or control by accessing your personal profile in your account or by contacting support via email. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records.
To ensure you receive the information you need to manage your account and protect your privacy, please be sure to keep your contact and billing information up to date. You can update all account-related information directly through your support site. Alternatively, you can contact SitesGy support through our online support link.
b. OUR COMMITMENT TO DATA SECURITY. We have implemented measures designed to protect personal information in our custody and control. We maintain reasonable administrative, technical and physical safeguards in an effort to protect against unauthorized access, use, modification and disclosure of personal information in our custody and control. Unfortunately, no data storage or transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information in transit and as stored on our systems or the systems of our third party service providers, you acknowledge that: (1) there are security and privacy limitations of the Internet which are beyond our control; (2) the security, integrity and privacy of any and all information and data exchanged between you and us through this website cannot be guaranteed; and (3) any such information and data may be viewed or tampered with in transit by a third party, despite our best efforts. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information.

E. WEBSITE HOLDER/USER ACCOUNT ACTIVATION
Upon completion of sign up for the premium plan offered, SitesGy will create a PayPal Express Checkout account on your behalf, using your email address. Depending on your location, SitesGy may also create a SitesGy Payments account on your behalf.
You acknowledge that PayPal Express Checkout and/or SitesGy Payments will be your default payments gateway(s) and that it is your sole responsibility as the Account Owner to activate and maintain these accounts.
If you do not wish to keep either of the payment accounts active, it is your responsibility to deactivate them. For the avoidance of doubt, PayPal Express Checkout is a Third Party Service.
In addition to this mode of payment, Stripe, BitCoin or Wire Transfer is also used or applicable.
If you are a resident of Guyana, you are responsible for all applicable Taxes that arise from or as a result of your subscription to or purchase of SitesGy services. These Taxes are based on the rates applicable to Guyana billing system. Such amounts are in addition to the Fees for such services and will be billed to your Authorized Card.
F. SITESGY TERMS OF CANCELLATION AND TERMINATION
You may cancel your Account at any point in time by emailing support@sitesbuilders.net and then following the specific instructions indicated to you in SitesGy response.
Upon termination of the Services by either party for any reason, SitesGy will cease providing you with the Services and you will no longer be able to access your Account. However, unless otherwise provided in the Terms of Service, you will not be entitled to any refunds of any Fees, pro rata or otherwise. In addition, any outstanding balance owed to SitesGy for your use of the Services through the effective date of such termination will immediately become due and payable in full; and your store website will be taken offline.
Moreover, if you purchased a domain name through SitesGy, upon cancellation your domain will no longer be automatically renewed. Following cancellation, it will be your sole responsibility to handle all matters related to your domain with the domain provider.
If at the date of termination of the Service, there are any outstanding Fees owing by you, you will receive one notification via email or call. Once that invoice has been paid in full, you will not be charged again.
However, we reserve the right to modify or terminate the SitesGy Service or your Website Holder Account for any reason, without notice at any time.
Lastly, SitesGy may suspend or terminate your Website Holder Account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.
G. SITESGY MODIFICATIONS TO PRICES OR SERVICES
The prices laid down for using the Services are subject to change upon 30 days’ notice from SitesGy. Such notice may be provided at any time via an email or call from SitesGy team of professionals.
In addition, SitesGy reserves the right at any time, and from time to time, to modify or discontinue, the Service (or any part thereof) with or without notice.
Moreover, SitesGy shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
H. THIRD PARTY SERVICES
In addition to these Terms of Service, you also agree to be bound by the additional service-specific terms applicable to services you purchase from, or that are provided by, SitesGy partners or other third parties.
SitesGy may from time to time recommend, provide you with access to, or enable third party software, applications (“Apps”), products, services or website links (collectively, “Third Party Services”) for your consideration or use. Such Third Party Services are made available only as a convenience, and your purchase, access or use of any such Third Party Services is solely between you and the applicable third party services provider (“Third Party Provider”). Any use by you of Third Party Services offered through the Services website is entirely at your own risk and discretion, and it is your responsibility to read the terms and conditions and/or privacy policies applicable to such Third Party Services before using them.
Moreover, we do not provide any warranties with respect to Third Party Services. You acknowledge that SitesGy has no control over Third Party Services, and shall not be responsible or liable to anyone for such Third Party Services.
If you install or enable a Third Party Service for use with the Services, you grant us permission to allow the applicable Third Party Provider to access your data and to take any other actions as required for the interoperation of the Third Party Service with the Services, and any exchange of data or other interaction between you and the Third Party Provider is solely between you and such Third Party Provider. SitesGy is not responsible for any disclosure, modification or deletion of your data or other Materials, or for any corresponding losses or damages you may suffer, as a result of access by a Third Party Service or a Third Party Provider to your data or other Materials.
Furthermore, under no circumstances shall SitesGy be liable for any direct, indirect, incidental, special, consequential, punitive, extraordinary, exemplary or other damages whatsoever, which result from any Third Party Services or your contractual relationship with any Third Party Provider, including any Expert. These limitations shall apply even if SitesGy has been advised of the possibility of such damages. The foregoing limitations shall apply to the fullest extent permitted by applicable law.
No indemnity claims will be allowed and this will be under any circumstance whatsoever!
You agree to indemnify and hold SitesGy, affiliates, officers, directors, agents, co-branders and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your Content, your use of the Service, your Guests activities, your connection to the Service, your violation of the TOS, or your violation of any rights of another, whether you are a registered website holder/user or not. The website holder/user is solely responsible for his or her actions when using the Service, including, but not limited to, costs incurred for Internet access.
I. LIMITATION OF LIABILITY AND EXCLUSION CLAUSES
You must expressly understand and agree that SitesGy shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
In no event shall SitesGy be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or these Terms of Service (however arising including negligence).
Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.
SitesGy does not warrant that the Service will be uninterrupted, timely, secure, or error-free; it also does not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
Lastly, SitesGy does not warrant that the quality of any services purchased or obtained by you through the Service will meet your expectations, or that any errors in the Service will be corrected.
Please note that certain SitesGy Services are currently offered in their BETA version, and undergoing BETA testing. You understand and agree that certain SitesGy Services may still contain software bugs, suffer disruptions and not operate as intended or designated. Your use of the SitesGy Services at this BETA stage signifies your agreement to participate in such SitesGy Services’ BETA testing.
DISCLAIMER: SITESGY WILL TAKE NO RESPONSIBILITY OR WILL NOT BE LIABLE FOR ANY CONTENT USED BY YOU OR ANYONE ELSE!
J. PROFESSIONAL STATUS
SitesGy Terms and your use of its services will not constitute any partnership, joint venture, employer-employee, franchisor-franchisee relationship between you and SitesGy.
K. ELUCIDATION
